Many people confuse electronic notarization with remote notarization, believing they are the same. They are not.
Electronic notarization, or eNotarization, involves documents that are notarized in electronic form, and the Notary and document signer sign with an electronic signature. But all other elements of a traditional, paper notarization apply to electronic notarization, including the requirement for the signer to physically appear before the Notary.
The confusion arises from the fact that remote notarizations typically involve digital documents that are signed and notarized electronically. However they go a step further in that the transaction is conducted online rather than in person.
An In-Person Electronic Notarization (IPEN) is a process where a signer and a notary public meet face-to-face to notarize digital documents. Unlike traditional notarization, IPEN uses electronic signatures and digital notary seals on a tablet, computer, or other device, eliminating the need for paper. The notary verifies the signer's identity in person, witnesses the electronic signing, and applies a digital seal, ensuring a secure and legally binding transaction. IPEN combines the efficiency of digital technology with the trust and security of in-person verification, commonly used in real estate closings and other legal agreements.
This method involves mailing paper documents to the signer in advance. The signer ink-signs the documents while being witnessed via webcam by a notary. The signed documents are then mailed back to the notary for final notarization.
A Remote Online Notarization (RON) is a process where a signer and a notary public notarize digital documents remotely via a secure online platform. Using video conferencing, electronic signatures, and digital notary seals, RON allows parties to complete transactions without meeting in person. The notary verifies the signer’s identity through digital methods, such as knowledge-based authentication or credential analysis, witnesses the electronic signing, and applies a digital seal. RON is widely used for real estate closings, legal agreements, and other transactions, offering convenience, security, and legal validity in jurisdictions where permitted.
A Hybrid Closing is a real estate closing process that combines elements of traditional in-person notarization and electronic or remote notarization methods. In a hybrid closing, some documents may be signed electronically, either in-person (via In-Person Electronic Notarization, IPEN) or remotely (via Remote Online Notarization, RON), while other documents are signed in person using traditional paper-based methods. This approach offers flexibility, allowing parties to leverage digital tools for efficiency while meeting legal or lender requirements for specific documents that must be signed in person. Hybrid closings are commonly used to streamline real estate transactions while ensuring compliance and security.
